A settlement has finally been reached in the longstanding US v. Rapanos, et al. case. On December 29, 2008, developer John Rapanos and related defendants agreed to pay a civil penalty in the amount of $150,000 and spend around $750,000 to fund a mitigation project. The project will involve the construction of at least 100 acres (including a buffer zone) to restore the functions and benefits of the 54 acres of wetlands filled by Rapanos, to monitor and maintain the mitigation project for 5 years, and to ensure that the mitigation project will be adequately funded. In the late 1980’s, John Rapanos and others were charged with violating CWA Section 301(a) by discharging dredged or fill material and controlling and directing the discharge of dredged or fill material into waters of the United States at six sites in Michigan, without authorization by the Corps or the State of Michigan.

At the 2008 Regulatory Conference, the 404-10 Group asked what wetland-related topics were most important.
Out of 18 choices, the top 7 most important wetland topics were (from most important to least):

- Delineating disturbed agricultural fields workshop
- Water Quality Certification – federal and state level
- Delineating managed timber tracts workshop
The remaining topics included:

The 404-10 Group will use this information to help plan future activities, workshops, and conferences.
